На днях полиция завела на проживающего в Лондоне петербургского бизнесмена Романа Василенко более десяти новых уголовных дел по отмыванию преступных доходов. Сам фигурант давно находится в розыске, однако в прошлом он считался весьма успешным и энергичным предпринимателем с занимательной биографией. В западной прессе его личность связывали даже с финансированием компании экс-президента США Дональда Трампа, а в российских медиа он в основном упоминается как организатор финансовой пирамиды, от которой пострадали тысячи людей по всей стране.
Главное следственное управление ГУ МВД России по Санкт-Петербургу и Ленинградской области на прошлой неделе возбудило в отношении беглого бизнесмена Романа Василенко, подозреваемого в организации преступного сообщества и мошенничестве в особо крупном размере, еще 13 уголовных дел, которые подпадают под легализацию денежных средств, полученных нечестным путем (ч. 4 ст. 174.1 УК РФ). По версии следствия, от деятельности его компании, которая работала под единым брендом Life Is Good (LIG, туда же входят Hermes Management Ltd. и «Бест Вей»), за восемь лет ее существования пострадало более 18 тыс. человек. По озвученной пресс-службой МВД России информации, гражданам предлагали стать пайщиками кооператива, обещая новое жилье без кабальных ипотечных условий, либо получение дохода, по самым скромным меркам, до 25% годовых. При этом деятельностью, связанной с инвестированием вкладов, как утверждает следствие, предприятие не занималось.

Для вступления в кооператив каждый клиент должен был сделать безвозвратный взнос в размере от €1 тыс. до €2 тыс. Далее требовалось накопить на счете в «Бест Вей» до 35–50% от стоимости выбранной квартиры, и только после этого пайщика ставили на очередь на приобретение жилплощади. Таким образом, квартира первому очереднику доставалась исключительно за счет вложений последующих пайщиков. При этом право собственности оформлялось на «Бест Вей» и переходило к конечному владельцу лишь после выплаты оставшейся суммы. Привлекательность этой схемы, по мнению ее авторов и самих клиентов, заключалась в гораздо меньших переплатах по сравнению с обычной ипотекой. Впрочем, признанные по этому делу пострадавшими теперь говорят, что деятельность «Бест Вей» фактически заключается лишь в перераспределении денег между пайщиками.

По информации ГУ МВД России по Петербургу и Ленобласти, с 2014 по 2022 год только 237 вкладчиков смогли полностью выкупить свои квадратные метры у потребкооператива. Притом что в пользование им было передано 2478 квартир.

Дело "Лайф-из-Гуд" — "Гермес" — "Бест Вей": потерпевшие изменяют показания

Приморский районный суд города Санкт-Петербурга рассматривает по существу уголовное дело № 1-504/24, связываемое с компаниями "Лайф-из-Гуд", "Гермес" и кооперативом "Бест Вей". Ведется допрос лиц, признанных следствием потерпевшими в рамках судебного следствия по делу. Предварительное расследование уголовного дела велось ГСУ ГУ МВД России по Санкт-Петербургу и Ленинградской области.

На скамье подсудимых — десять граждан, из них четверо: Анна Высоцкая, Александра Григорьева, Михаил Измайлов и Елена Соловьева — находятся под стражей уже более двух лет, хотя УПК установлен предельный срок содержания под стражей на этапе предварительного расследования — полтора года. Альмира Гильберт, Дмитрий Мазанов, Анатолий Наливан, Денис Шишко были арестованы в 2023 году и находятся под арестом более года. Более года под домашним арестом находится Дмитрий Выдрин и под запретом определенных действий — 83-летний Виктор Василенко, отец Романа Василенко, основателя компании "Лайф-из-Гуд" и кооператива "Бест Вей". Приморский районный суд продлил всем подсудимым меры пресечения на полгода, что оспаривается адвокатами в вышестоящих судах.

Всем подсудимым предъявлены обвинения как в мошенничестве (ч. 4 ст. 159 УК РФ) и создании "финансовой пирамиды" (ч. 2 ст. 172.2 УК РФ), так и в организации преступного сообщества (ч. 3 ст. 210 УК РФ). Их, а также гражданских ответчиков — прежде всего кооператив "Бест Вей" — защищают почти два десятка адвокатов.

МВД объявляло, что на скамье подсудимых — руководители "Лайф-из-Гуд", однако независимые наблюдатели выражают в этом сомнения. Так, Анна Высоцкая к моменту ареста уже полгода не работала в компании "Лайф-из-Гуд", а до этого занималась там организационно-техническим обеспечением конференций, проводимых этой компанией, а также отвечала за информационную часть интернет-сайта. Александра Григорьева была директором одного из вспомогательных юридических лиц фирмы "Лайф-из-Гуд", а фактически, насколько известно, являлась помощником Романа Василенко по общим вопросам. Елена Соловьева работала главным бухгалтером ООО "Эксперт" — компании, занимавшейся юридической проверкой и организацией оценки недвижимости, приобретаемой кооперативом "Бест Вей". Михаил Измайлов — индивидуальный предприниматель и рядовой пайщик кооператива "Бест Вей"; Анатолий Наливан — также индивидуальный предприниматель, пайщик кооператива и уполномоченный пайщиков "Бест Вей" от крупного региона; Дмитрий Мазанов — ИП и рядовой пайщик; Альмира Гильберт и Дмитрий Выдрин на момент привлечения в качестве обвиняемых не работали.

Первым среди лиц, признанных потерпевшими, судом был допрошен Логинов — но его допрос был прерван прокуратурой, перенесен на следующее заседание суда, на которое Логинов не явился, сославшись на то, что находится в отпуске. Выяснение оснований для претензий со стороны Логинова будет продолжено на новом его допросе.
